G. Allen Dale obtains misdemeanor plea and unsupervised probationary sentence in federal internet pharmacy case. In the United States District Court for the District of Columbia, Dale, working with attorneys from Schertler & Onorato, obtained a misdemeanor plea and a sentence of unsupervised probation for a pharmacist who originally was charged in a four-count federal indictment that included felony charges under both the Controlled Substances Act and the Federal Food, Drug & Cosmetic Act relating to Internet sales of prescription drugs. In August 2016, Dale prevailed on a motion to dismiss all the Controlled Substances Act counts. The motion raised new meritorious arguments concerning a legal issue on which several other federal courts had ruled in the government's favor. Dale then negotiated a plea agreement for a single misdemeanor, on which the firm's client was sentenced to unsupervised probation and a monetary fine.
